These User Terms of Service govern your access to and use of the Your Migration Partner platform, website, booking system, consultation features, public forum, guides, resources, blogs, news, documents and related services.

Acceptance of Terms

By creating an account, accessing the platform, booking a consultation, making a payment, submitting information, uploading documents, asking a forum question, downloading resources, reading platform content or otherwise using the platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the platform.

Independent Agents

Migration advice is provided by independent Registered Migration Agents, not YMP.

Secure Payments

Payments may be processed by third-party providers such as Stripe.

General Information

Forum answers, blogs, news and resources are general information unless personalised advice is booked.

1. About Your Migration Partner

Your Migration Partner Pty Ltd operates a digital platform that connects users, including migrants, prospective migrants, international students, visa applicants, family members and sponsors, with independent Registered Migration Agents registered with the Office of the Migration Agents Registration Authority.

YMP provides technology, booking, payment, communication, platform support, marketing, educational content, general information, guides, blogs, news updates and document access services.

YMP does not provide migration advice, legal advice, visa assistance, immigration representation, document lodgement services, or professional migration services. All migration advice and professional migration services are provided solely by independent Registered Migration Agents or other authorised professionals.

2. YMP Is Not a Migration Agent

YMP is not a Registered Migration Agent, legal practitioner or immigration adviser.

YMP does not assess your eligibility for any visa, prepare or lodge visa applications, communicate with the Department of Home Affairs on your behalf, or guarantee any visa outcome, migration outcome, processing time, approval, invitation, nomination, refund or government decision.

Any migration advice you receive through the platform is the sole responsibility of the Registered Migration Agent providing that advice.

3. Eligibility

To create an account or use the YMP platform, you must be at least 18 years old, have legal capacity to enter into a binding agreement, provide accurate and truthful information, use the platform for lawful purposes only, and not be prohibited from using the platform under any applicable law.

If a person is under 18 years of age, a parent or legal guardian must use the platform on their behalf.

4. User Accounts

To access certain platform features, you may be required to create a user account.

You agree to provide accurate registration information, keep your account details up to date, keep your login details confidential, not share your account with another person, notify YMP if you suspect unauthorised access, and remain responsible for all activity under your account.

5. Platform Features

Depending on the features available from time to time, users may be able to browse agent profiles, book paid consultations, attend video or audio consultations, submit pre-consultation forms, upload documents, message agents during a consultation chat, ask questions in a public forum, read answers from Registered Migration Agents, access resources and documents, read blogs and news, leave reviews, and receive service-related email reminders.

YMP may add, remove, suspend, modify or restrict platform features at any time. Some resources may only be available to users who create an account and log in.

6. Agent Profiles and Verification

YMP takes reasonable steps to verify the OMARA registration status of agents before allowing them to appear on the platform and may conduct periodic checks.

Agents are responsible for maintaining accurate profile information and valid professional registration. Users may independently verify an agent’s registration status through OMARA.

If YMP becomes aware that an agent’s registration is suspended, cancelled, inactive, expired or otherwise unsuitable, YMP may suspend or remove the agent from the platform.

7. Bookings and Consultations

Users may book consultations with Registered Migration Agents through the YMP platform. Consultations may be offered by video call, audio call, telephone call, online meeting or another method approved or facilitated by YMP.

You are responsible for selecting the agent, choosing an available consultation time, providing accurate pre-consultation information, attending on time, ensuring your device and internet connection are working, and asking relevant questions during the consultation.

A consultation does not guarantee that the agent will accept you as a client for further migration services.

8. Pre-Consultation Forms and Uploaded Documents

Before a consultation, YMP may ask you to complete a form containing information such as your contact details, visa history, education, employment background, English test results, qualifications, migration goals and other relevant information.

You may also be given the option to upload documents. All information and documents you provide must be accurate, complete, lawful and not misleading.

You must not upload fake, altered, misleading, fraudulent, unauthorised or unlawfully obtained documents or information. Documents uploaded through the platform may be shared with the relevant agent for the purpose of preparing for or providing the consultation or related service.

9. Payments, Fees and Pricing

All payments for consultations, document review services, visa lodgement services, migration services and other professional services booked or arranged through YMP must be made through the YMP platform unless YMP confirms otherwise in writing.

Users must not make direct payments to agents for YMP-sourced services for the purpose of avoiding platform payment processes, fees, commissions or records.

Payments may be processed through third-party payment providers, including Stripe. YMP does not store your full credit card or debit card details.

Agents generally set their own professional fees unless YMP publishes a fixed platform price for a specific service. YMP is not currently registered for Goods and Services Tax. Unless otherwise stated, fees displayed on the platform are GST-exclusive and do not include a GST component.

10. Consultation Cancellations, Rescheduling and No-Shows

If you cancel a scheduled consultation at least 24 hours before the appointment time, YMP may provide a refund or allow rescheduling, depending on the applicable booking rules displayed on the platform.

If you cancel less than 24 hours before the scheduled consultation time, no refund will be provided unless YMP determines otherwise at its sole discretion or unless required by law.

If you are more than 15 minutes late or do not attend a scheduled consultation, the agent may treat the consultation as a user no-show and no refund will be provided unless YMP determines otherwise or unless required by law.

If an agent is late, does not attend, or is unable to proceed, YMP’s standard remedy is to assist in arranging a new consultation time with the same agent or, where appropriate, with a different agent.

11. Technical Issues

If a consultation cannot proceed due to a technical issue with the YMP platform, YMP may assist in arranging a new consultation time.

If the technical issue is caused by your device, internet connection, settings, location, browser, microphone, camera, software or failure to join correctly, you will not automatically be entitled to a refund.

If both you and the agent agree, the consultation may continue through another suitable method, including phone, Zoom, Google Meet, WhatsApp or another suitable communication channel.

12. Refunds for Professional Services

Professional migration services may include visa lodgement services, document review services, written advice, migration strategy, application preparation or other services provided by an agent.

Subject to Australian Consumer Law and any written agreement between you and the agent, payments for professional services are generally non-refundable once the service has commenced, work has been performed, advice has been provided, documents have been reviewed, or the agent has allocated time and resources to your matter.

Refunds will not generally be provided because you change your mind, are dissatisfied with advice, your visa is refused or delayed, your circumstances change, you fail to provide information on time, you provided incorrect information, or an outcome is not what you expected.

Nothing in these Terms excludes, restricts or modifies any rights, remedies or consumer guarantees you may have under Australian Consumer Law or other laws that cannot be excluded.

13. Separate Agreements With Agents

For some professional migration services, including visa application or visa lodgement services, you may be required to enter into a separate agreement, client engagement letter, cost agreement, authority or other professional document directly with the agent.

The agent is responsible for providing any required client agreement, cost agreement, scope of work, disclosure, appointment form or professional document. YMP is not a party to the professional engagement between you and the agent, except to the extent that payment is processed through the YMP platform.

14. Responsibility for Migration Advice and Services

The agent, and not YMP, is solely responsible for migration advice, visa strategies, eligibility assessments, document requests, preparing or lodging visa applications, communication with government bodies, professional conduct, compliance with OMARA obligations, professional indemnity insurance, and the quality, accuracy and suitability of advice given.

YMP is responsible only for operating the platform, facilitating booking and payment technology, displaying agent profiles, providing access to general resources and content, and providing reasonable platform support.

15. No Guarantee of Visa or Migration Outcomes

YMP does not guarantee visa approval, visa invitation, state or territory nomination, employer sponsorship, skills assessment success, English test outcomes, processing times, refund outcomes, agent availability, the accuracy or suitability of advice provided by agents, or any result from using the platform.

All visa and migration decisions are made by the relevant government department, tribunal, skills assessment body, state or territory authority, employer, education provider, court or other relevant third party.

16. No Emergency or Urgent Response Guarantee

YMP is not an emergency migration advice service and does not guarantee same-day consultations, urgent agent availability, immediate responses, emergency document review, urgent visa lodgement, availability before a visa deadline, or any particular response time from agents.

You are responsible for monitoring your own visa deadlines, expiry dates, bridging visa conditions, appeal deadlines, nomination deadlines, document deadlines and other time-sensitive matters.

17. Public Forum

The platform may allow users to ask questions in a public forum. Forum questions may be visible to other users after admin approval.

Users may post forum questions without their name or username being displayed publicly. However, YMP may still identify the account associated with the question for moderation, compliance, security and platform management purposes.

You must not include sensitive personal information in public forum questions, including passport numbers, visa grant numbers, home addresses, phone numbers, email addresses, financial information, health information, identity document numbers, Department of Home Affairs reference numbers or other identifying information.

18. Forum Answers and General Information

Forum answers may be provided by Registered Migration Agents, but forum answers are general in nature unless a formal consultation or professional service is booked.

Forum answers may not consider your full personal circumstances, may not include a complete assessment of your visa options, may become outdated, and are not a substitute for personalised migration advice.

You should book a consultation with a Registered Migration Agent if you require personalised advice.

19. Blogs, News, Guides, Documents and Resources

YMP may publish or provide access to free or paid content, including blogs, news updates, articles, videos, social media content, PDFs, guides, brochures, checklists, templates, spreadsheets, official media releases, government updates, downloadable resources and other materials.

Some resources may require users to create an account and log in before access is provided. All YMP content and resources are provided for general information and educational purposes only.

YMP content is not migration advice or legal advice, may not apply to your personal circumstances, may become outdated, and should not be relied upon as a substitute for advice from a Registered Migration Agent.

20. Reviews and Ratings

Users may be allowed to leave reviews or ratings for agents after completing a consultation booked through YMP.

Any review or rating you submit must be genuine, honest, fair and based on your own experience. YMP may review, edit, reject, remove or refuse to publish any review or rating at its discretion.

21. User Responsibilities

You are responsible for providing truthful and complete information, keeping your account details up to date, checking your visa deadlines, supplying requested documents on time, attending consultations on time, reading advice and agreements carefully, making your own final decisions, asking questions if you do not understand advice, and complying with these Terms and all applicable laws.

22. Prohibited Conduct and Platform Circumvention

You must not use the platform for unlawful, fraudulent, misleading, abusive or dishonest purposes; provide false information; upload fake or unauthorised documents; impersonate another person; create multiple accounts to avoid restrictions; interfere with security; attempt to access another user’s account; upload harmful code; misuse platform features; harass agents, users or YMP staff; post unlawful content; or attempt to bypass the YMP payment system.

You agree not to use YMP to identify, contact, approach, book or engage an agent and then bypass the platform for payment or service delivery. YMP may suspend or terminate your account if you attempt to circumvent the platform.

23. Communications and Email Notifications

By creating an account or using the platform, you agree that YMP may contact you by email for service-related purposes, including registration, booking confirmations, reminders, payment confirmations, rescheduling updates, refund or dispute updates, platform notices, security notices, legal updates and customer support.

YMP may also send marketing emails, newsletters, platform updates, content updates, resource updates, blog updates, news updates or promotional material where you have consented or where permitted by law. You may unsubscribe from marketing communications, but you may still receive important service-related emails.

24. Third-Party Services

The platform may rely on third-party services, including payment processors, video call providers, cloud hosting providers, email providers, analytics tools and other technology services.

YMP is not responsible for outages, errors or delays caused by third-party services, payment provider issues, video call provider failures, email delivery failures, internet or telecommunications issues, or third-party terms, policies or data handling practices.

25. Privacy and Account Closure

Your use of the platform is subject to YMP’s Privacy Policy. By using the platform, you acknowledge that YMP may collect, use, store, disclose and manage your personal information in accordance with the Privacy Policy.

You may request closure of your user account by contacting YMP at info@yourmigrationpartner.com. YMP may retain certain information after account closure where reasonably necessary for legal compliance, tax, accounting, payment or transaction records, dispute handling, fraud prevention, security purposes, platform integrity, enforcement of these Terms or any other lawful purpose described in the Privacy Policy.

26. Suspension and Termination

YMP may suspend, restrict, disable or terminate your account or platform access at any time if YMP reasonably believes you have breached these Terms, breached any applicable law, provided false or fraudulent information, uploaded fake or unlawful documents, misused the platform, attempted to bypass platform payments, initiated an improper chargeback, behaved abusively, created risk for YMP, or otherwise acted in a way that may harm the platform or its users.

27. Complaints, Disputes and Chargebacks

If you have a complaint about the platform, a booking, payment, consultation, agent, forum answer, resource, document, blog, news update or other issue, you may contact YMP at info@yourmigrationpartner.com.

Please include your name, account email, booking details, agent name, relevant dates and a clear description of the issue.

If you initiate a chargeback, payment dispute, reversal or claim through your bank, card provider or payment provider, YMP may investigate the transaction, request information, suspend your account while the matter is reviewed, provide evidence to the payment provider, restrict future bookings, recover unpaid amounts and terminate your account where the dispute is fraudulent, misleading, abusive or improper.

28. Platform Availability

YMP aims to provide a reliable platform but does not guarantee that the platform will always be available, uninterrupted, secure, error-free or free from technical issues.

The platform may be unavailable due to scheduled or emergency maintenance, technical faults, cyber incidents, hosting provider issues, payment provider issues, video provider issues, internet or telecommunications failures, legal requirements or circumstances beyond YMP’s reasonable control.

29. Intellectual Property and User Content

All intellectual property rights in the YMP platform, website, branding, logos, software, systems, databases, design, text, graphics, videos, guides, PDFs, checklists, templates, resources, blogs, news updates, downloadable materials and other content belong to YMP or its licensors.

You retain ownership of content you submit to the platform, including forum questions, reviews, form responses, uploaded documents and messages. By submitting content, you grant YMP a licence to use, store, display, process, transmit, moderate, edit, remove and share that content for operating the platform, providing services, managing bookings, supporting users, complying with law and enforcing these Terms.

30. Limitation of Liability

To the maximum extent permitted by law, YMP is not liable for migration advice or professional services provided by agents, visa refusals or delays, decisions made by government bodies or third parties, inaccurate or unsuitable advice provided by agents, disputes between users and agents, loss caused by your inaccurate information or missed deadlines, platform downtime, third-party service failures, indirect or economic loss, or reliance on general platform content without obtaining personalised advice.

To the extent permitted by law, YMP’s total liability to you in connection with the platform or these Terms is limited to the total amount you paid to YMP in the 12 months before the event giving rise to the claim.

31. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantees, rights, remedies or protections that cannot be excluded under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law.

Where YMP is permitted to limit its liability, YMP’s liability is limited, at its option, to re-supplying the relevant platform service or paying the cost of having the relevant platform service supplied again.

32. Overseas Users

YMP may be accessed by users located in Australia and overseas. If you access the platform from outside Australia, you are responsible for complying with any local laws that apply to you.

YMP is operated from Australia and these Terms are governed by the laws of Victoria, Australia.

33. Changes to These Terms

YMP may update these Terms from time to time. Where material changes are made, YMP may notify users by email, platform notice or another reasonable method.

Continued use of the platform after updated Terms take effect constitutes acceptance of the updated Terms. If you do not agree with the updated Terms, you must stop using the platform and may request account closure.

34. Electronic Acceptance

By ticking the checkbox or clicking the relevant acceptance button during account registration, you confirm that you have read, understood and agree to be bound by these Terms and the YMP Privacy Policy.

Your electronic acceptance is intended to create a legally binding agreement. YMP may maintain electronic records of your acceptance, including the date, time, account email, IP address, acceptance method and version of the Terms accepted.

35. Governing Law and Jurisdiction

These Terms are governed by the laws of Victoria, Australia and the Commonwealth of Australia.

The parties submit to the exclusive jurisdiction of the courts of Victoria, Australia, in relation to any dispute arising out of or connected with these Terms or the platform.

YMP is not a migration agent and does not provide migration advice. You should book a consultation with a Registered Migration Agent if you require advice about your personal circumstances.
